Luxury Chocolatier Threatened By Hershey's Over Kiss Trademark

You wouldn't think that chocolatier Jacques Torres would have to worry about his products catching the eye of Hershey's. But Torres makes a rather delicious confection called the champagne kiss which is chocolate kissed with Taittinger Rose champagne and decorated with a lip print ($57.50 for a box of 50). This caught the attention of the Hershey Company which had their lawyers send Torres a letter claiming that kiss and kisses are Hershey's trademarks and that Torres discontinue the use of the words in connection with his chocolates.

The best part of this story is the reply from Torres's lawyer which NY Magazine's Grub Street has reproduced. It says that Jacques Torres will not discontinue use of the name and that the request is "yet another example of a giant, monolithic corporation attempting to take advantage of 'the little guy,' in this case, a world-renowned artisan from France." The letter goes on to say that the two products could never be confused and that "the analogy might be similar to Chevrolet complaining that Rolls Royce is infringing on the Chevrolet trademark." Certainly it is true that no one is likely to confuse the two products but is a kiss still a kiss? A quick Google search of the phrase "chocolate kisses" pulls up pages of recipes, Hershey products and even a book and a nail polish that use the phrase as titles, but not a sign of Torres's chocolates.

DNA11, a company which we have covered before for their personalized artwork offerings has a new idea, using a lipstick print as art. The process begins with a Kiss collection kit that includes M.A.C. Viva Glam lipstick. You apply the lipstick and make a lip print on the provided sheets. The sheets are then sent in and the company creates artwork from your kiss. The kiss can be ordered in a variety of colors and sizes which start at $290. A portion of every Kiss portrait goes toward the towards the M·A·C Aids fund.

Paul Stanley, A Rock Star Turns Artist

The cadre of celebrity artists gets another rocking member. Kiss guitarist Paul Stanley, best known for painting his own face, has translated his skills to the canvas. Stanley is a graduate of the prestigious high school of Music and Art in NYC. He is staging two exhibitions with art retailer the Wentworth Gallery in Palm Beach Gardens and Boca Raton, Florida. The gallery is selling giclees of his work on canvas. The work includes pictures of himself and his bandmates as well as muddy spheres and hearts. It's a good thing this artist has a well-paying day job.

Woman Arrested for Kissing $2.7 Million Dollar Painting

Normally a kiss as a sign of affection is a good thing, but when it happens in an art gallery on a $2.7 million dollar painting it's not only not a good thing -- it's a crime. It happened last Thursday in the Museum of Contemporary Art in Avignon, France. The woman, 30-year-old Sam Rindy, had apparently been admiring a 9'x6' bone white painting by Cy Twombly valued at over £1 million and was suddenly overcome and just had to kiss it. She's quoted as saying "The artist left this white for me."

Yeah, well it's not white anymore since there's a lipstick imprint left behind. Ms. Rindy is awaiting trial on August 16 for "damage to a work of art."

Limited Edition Celebrity Wines

Celebrity Cellars has brought us Madonna-themed wine in the past and now they are releasing several new varieties of celebrity wines. Kiss This is a wine dedicated to the band KISS, featuring artwork from their 1978 Destroyer album on the bottle. The wine itself is actually a 2004 Alexander Valley Cabernet Sauvignon with notes of plum, cherry and cassis. 1000 bottles of Kiss This are available at $100 per bottle.

The Rolling Stones Collection features 8 different etched designs on various kinds of wine. Designs range from the Classic Tongue logo to the Spiky Tongue, which commemorates a 1994 world tour. The available wines include everything from a nonalcoholic Unwine at $25 each to a 2004 Dry Creek Cabernet Sauvignon at $100 per bottle.

KISS Plans "Elegant" Fragrance Line

You would think the day for this had long since passed but according to WWD, KISS is coming out with a fragrance line. The band signed a deal with Gemini Cosmetics to do men's and women's scents. What does KISS smell like? The scents are going to be elegant, sexy and emblazoned with the KISS logo. The article quotes band member Paul Stanley as saying that "this is the fragrance for people who dare to be like KISS — not fans of KISS." Stanley also recently designed a guitar line and says the band is working on an apparel line.
