The phrase "judgment notwithstanding the verdict" abbreviated JNOV, which stands for its Latin equivalent, judgment "non obstante veredicto." The remedy of JNOV applies only in cases decided by a jury. Originally this remedy could be entered only in favor of the plaintiff, and the similar remedy of arrest of judgment could be entered only in favor of the defendant. Under modern law a JNOV is generally available to both plaintiffs and defendants, and an arrest of judgment is primarily used with judgments in criminal cases. A JNOV is proper when the court finds that the party bearing the Burden of Proof fails to make out a Prima Facie case (a case that on first appearance will prevail unless contradicted by evidence).

Mar 11th 2011 12:30AM This is nothing new to anyone who has every had a parent in this situation, and it gets worse when they pass. Everyone is out for themselves..."what can I get".."what did they leave me"..."moma said I can have the house". In this case the husband will have survivorship in the event Ms. James passes, unless there is a will to say otherwise. The son has a POA and the husband is challenging the validity of the document because he thinks Ms. James was not in her right mind to give that power to her son...(Trust issues with the husband come to mind)...If the poa stands it will give the son the power to move the money from her accounts leaving nothing for the surviving spouse if Ms James passes. Family...can't live with them...can't survive without them...and they can sure act a fool when their loved one passes away.

Then why didn't she explain what was going on with that pic...or did she mean to say...that dirty ex of mine put this pic out of me gettin high because he's mad I broke it off with him. First lesson learned...be careful who you surround yourself with. Second lesson...when caught...tell the truth...it really doesn't matter to me what she does and who she does it with...but she should'nt think she can lie her way out of this one to the whole world...baby you haven't been on this earth long enough to do that. Tell the truth and move on.

Feb 27th 2011 4:29PM I can't believe some of the the comments I have read here today. I think this young woman is as strong as they come. Losing her father at such a young age, and she stood back up, won the teen beauty pageant and earned her Degree. Her mother fell ill, she stood back up and won the Miss. Colorado pageant. Her mothers health got worse and they loss the roof over their head and she's still standing. Found out she will be losing her job, yet SHE'S STILL STANDING TALL AND PLANNING TO ENTER A PAGEANT STRIVING FOR THE NEXT LEVEL. Sometime this life we are living won't seem to be fair and we fall down, but thats when faith steps in and gives you the strenth to get back up.

Feb 10th 2011 8:42PM Why does it matter to anyone why she divorced Steve, if was because of adultery, its not against man's law...God's law yes...but thats for Steve to deal with when he gets to those pearlly gates.
Although we haven't seen a copy of this settlement, if its true this just means she has spent the money and or lost the homes and wants more. Once the papers are sighed...thats it...no mas...no mo for you. She sholud have stayed with him and drove him crazy, and spent as much of his money on stupid stuff and made him divorce her...then she probably could have gotten more out of him.
I know Majorie...we went to high school together and she is the sweetest person you could ever know. She and Steve both had their go at 2 other marriges that didn't work and have finnaly found their way into each others arms. Let's leave them alone and be happy for them and let the past be the past. Feb 5th 2011 8:53PM Open marriages are just that...open. It does not always have to be about sex, even though sex with other people outside the marriage occurs, its a mind...set. It's not for everyone...let me explain.
Normally when two people are married, everything that happens in their lives happens between them. Men don't fool around on their wives because they don't love them...it's normally because they have met another woman that turns them on physically. Women normally don't fool around on their husbands for the same reason, either their husband has been caught cheating and she wants to get even, or her man is not giving her what she needs. You see...a woman can be loving her man dang near into a coma and he will still cheat.
An open marriage is a state of mind...see men think they can get all the coochie they want, take a shower..(Don't use her soap guys, and go by the club to get some smoke in your clothes to help get her scent off you)and think everything is ok...but don't let him find out I've been with his wife...now he's ready to kill everybody.
You have to be a couple of special people to have an open marrige and be able to talk to one another about the other lover...I already know I can't do it...Can you???
