The temporary competitive advantage should exist only as long as the market permits. Inventors usually do not make their research papers public, so for a competing company, it would take some time until it realizes that there is a new invention. When the competition starts the process of catching up, the original inventor is already producing and selling. The original inventor has an option to keep his ideas secret as long as possible. This is a competitive advantage.
On the other hand, patents have the effect of making the marketplace less free. When a company does not want to invest in further innovation it tries to stop the competing companies from improving their products by force. But, because one company usually does not have enough resources to generate enough force againts it's competitors, it outsources this task to the government. This is the real rationale behind patents.

I am certainly not kidding. Patent is a monopoly granted by the government. Yes the invention comes from the inventor, but his reward should be a temporary competitive advantage until others catch up. By granting him a monopoly, the result is a) slowing of further research (because there is no pressure from competition, thanx to the monopoly), b) less choices available to consumers, c) higher product prices (again, because of the lack of the competition), which all leads to waste of resources...
I think that the Chinese government is making a mistake when it enforces "intellectual property" rights at all. They are losing one of their competitive advantages. It is obvious that the lack of "intellectual property" rights enforcement was NOT really a problem, because the western companies were investing there anyway.

Mar 22nd 2006 6:24PM If using someone elses design to build a product for profit is theft, then baking a bread according to someone elses recipe is theft too. Or filming a sitcom is theft too (because all sitcoms are just a compilation of recycled ideas). Or how about building a house? Home builders usually aren't the inventors of the methods they use. Does that mean that they are stealing "intellectual property"?
